TERMS AND CONDITIONS

The following are the terms and conditions for participating in the FIG Jewelry Club's Distributor/Affiliate Program. "Distributor/Affiliate" refers to yourself, and FIG Jewelry Club refers to us. FIG Jewelry Club is located at 

Payments and Commissions:
FIG will pay the Distributor/Affiliate $1.04 for every FREE gold pendant requested plus 15% commission from every sale produced by a visitor from Distributors/Affiliates website using their unique Distributor/Affiliate Link. Each Affiliate may signup Distributors/Affiliates and receive a commission for each of the Affiliate's sales.

For each Affiliate that signs up with Fortunes In Gold as a result of your marketing you will receive 5% LIFETIME COMMISSIONS on all sales produced by your down line, plus .35 cents for each pendant your team gives away.

For each Distributor sign up, you will receive a Bonus commission of 40%, plus a residual LIFETIME COMMISSION of 5% of any additional sales, you will also receive .35 cents for each free pendant given away by your down line.

All commissions shall be paid by company check approximately every 30 days, approximately 15 days after the prior period. Fortunes in Gold reserves the right to modify the payment schedule as long as notice is posted to the website. If commission does not exceed $50.00 for prior period, FIG reserves the right to hold payment until commissions accumulate to $50.

Although the Distributor/Affiliate Program is not limited to the U.S. all payments will be made in U.S. dollars.

If a qualifying sale is canceled or refunded, the related commission will be deducted from the next monthly payment.

Distributors/Affiliates are NOT employees of FIG and are responsible for their own local, state, or country taxes.

All Distributor/Affiliate applications are subject to approval by FIG Jewelry Club.

Both FIG and the Distributor/Affiliate reserve the right to terminate this agreement at any time with a 30 day notice. If terminated, outstanding commissions for current period at time of cancellation shall be paid in the next monthly payment so long as rules of this agreement were not violated by the Distributor/Affiliate.

Distributor Link:
You will be issued a "Distributor/Affiliate Link", or unique URL, which allows us to identify visitors directed from you or from your site as originating from you. These visitors are tracked with this unique URL and sales are recorded with your Distributor/Affiliate Id. To receive commissions you must use the provided Distributor/Affiliate website link.

FIG Jewelry Club reserves all rights in or to its trademarks and service marks but may be used by Distributors/Affiliates in accordance with this agreement. Distributor/Affiliate may in no way display a  FIG Jewelry Club logo, image, or trademark which may be distasteful, defame, or misrepresent.

Distributor/Affiliate shall not misrepresent FIG Jewelry Club products or services.

Distributor/Affiliate is solely responsible for insuring that their Distributor Link is setup properly to qualify for commissions.

Distributor/Affiliates agrees to not send unsolicited mail or SPAM mail to promote any of FIG Jewelry Club products or services. This action WILL RESULT in immediate termination of your account with a cancellation of any pending commissions. Distributor will also be in violation of the FIG Jewelry Club Distributor/Affiliate Agreement and subject to legal action.

Prohibited Sites:
Sites that promote sexually explicit material or violence do not qualify as a Distributor/Affiliate. Sites that promote discrimination based on race, sex, religion, national origin, and physical disability, shall not be accepted. Sites that promote illegal activities shall not be accepted. Do not apply if your site promotes these kinds of activities. By applying, you are stating that your site does not directly or indirectly promote or endorse these activities.

Term of agreement:
This agreement remains in affect until cancelled by either party.

Commissions earned through the date of expiration or cancellation of this agreement will remain payable only if the qualifying sales are not cancelled or refunded by the referred customers. Payment of the final commission payment to the Distributor/Affiliate may be withheld for a reasonable time in order to ensure that the correct amount is paid.

Disclaimer:
FIG Jewelry Club will make every reasonable effort to track and pay commissions for all sales that apply to Distributor/Affiliate. However, FIG Jewelry Club is not responsible for technical problems, acts by third parties, or other events outside our reasonable control which may temporarily disrupt or diminish this service.

Privacy:
To protect FIG Jewelry Club customer privacy, we cannot provide identifying customer names and/or contact information to you. However, we will provide an online report detailing price, service, date of sale, and other data for your records.

Independent Contractor:
The relationship between FIG Jewelry Club and Distributor/Affiliate established by this Agreement is that of independent contractors. FIG Jewelry Club and Distributor/Affiliate shall each conduct its respective business at its own initiative, responsibility and expense, and shall have no authority to incur any obligations on behalf of the other, except as otherwise provided herein. Term "Distributor/Affiliate" shall not be interpreted as a legal partner or affiliate, simply as an independent contractor for FIG Jewelry Club under this agreement.

Limitation of Damages:
FIG Jewelry Club shall not be held liability for any indirect, incidental, special, consequential damages, or any loss of revenue or profits arising under or with respect to this agreement or program, even if FIG Jewelry Club has been advised of the possibility of such damages. FIG Jewelry Club aggregate liability arising under or with respect to this agreement or the program shall in no event exceed the total commissions paid or payable by FIG Jewelry Club under this agreement.

Distributor/Affiliates understands that tracking can never be 100% accurate and FIG Jewelry Club is not responsible for inaccuracies that might occur beyond its control. Tracking of sales depend on several factors which are out of the control of FIG Jewelry Club. It is the goal of FIG Jewelry Club to make Distributor as accurate as possible, however, FIG Jewelry Club cannot guarantee 100% tracking for situations beyond its control.

Warranty Disclaimer:
FIG Jewelry Club makes no warranties expressed or implied with regard to Distributor/Affiliate Program except as outlined in this agreement.

Governing Law:
The laws of the British Commonwealth shall govern this agreement.

EARNINGS DISCLAIMER
